Maryland’s Statute of Limitations for Birth Injury Cases

Do not wait to explore your legal options with a qualified legal professional if your child was born with a birth defect. You will only have a limited amount of time to pursue legal action, as the state of Maryland enforces time limits for legal action involving birth injuries. In most cases, you will be unable to recover any compensation if do not file a lawsuit by the applicable deadline.

Both parents and the injured child can file separate lawsuits seeking to recover compensation for the same injury. Parents will have five years from the date of the injury (generally the delivery date) or three years from the date they discovered the injury, whichever comes first, to initiate legal action. The injured child will have three years from the date they turn 18. Should a birth defect result in the death of a child, the parents will have three years from the date of the child’s passing to file a wrongful death claim.
